Terms of Service

These Terms govern your use of JobSelect Labs, JobAnalyze 6k, the JobSelect CLI, hosted API, and MCP server.

This document is intended as a general-purpose Terms of Service and is not legal advice. Consider obtaining qualified legal review for your jurisdiction and business model.

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of JobSelect Labs services, including jobselect.vercel.app, the JobSelect web application, JobAnalyze 6k, the hosted JobAnalyze API, the JobSelect CLI, and the JobAnalyze MCP server (collectively, the "Services").

By accessing or using the Services, creating an account, generating an API key, installing the CLI, or calling an API or MCP endpoint, you agree to these Terms. If you do not agree, do not use the Services.

2. About the Services

JobSelect Labs provides software and machine-learning tools for analyzing job descriptions, extracting skills, and producing job-related compatibility or classification outputs.

The Services may include experimental, beta, or continuously updated functionality. Features, models, endpoints, limits, and availability may change without notice.

3. Eligibility and Accounts

You must provide accurate information when creating an account and are responsible for maintaining the security of your credentials and API keys.

You are responsible for all activity performed through your account or API keys. Do not share API keys publicly, commit them to source control, or use another person's credentials without authorization.

You must notify JobSelect Labs promptly if you believe an account or API key has been compromised.

4. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You must not:

  • Circumvent authentication, rate limits, access controls, or usage restrictions.
  • Attempt to gain unauthorized access to the Services, infrastructure, accounts, databases, or other users' data.
  • Probe, scan, overload, disrupt, reverse engineer, or interfere with the availability or security of the Services except where expressly permitted by applicable law or an applicable open-source license.
  • Use the Services to distribute malware, spam, fraudulent content, or unlawful material.
  • Abuse the API or MCP server through automated traffic intended to degrade service for others.
  • Misrepresent automated JobSelect output as a guaranteed human or employer decision.
  • Use the Services in a way that violates applicable laws or regulations.

5. Job Analysis Outputs

JobSelect outputs are informational and algorithmic. They are not guarantees of employment, interview selection, hiring outcomes, candidate suitability, compensation, or the accuracy or completeness of a job description.

You are responsible for reviewing outputs and making your own decisions. JobSelect should not be used as the sole basis for high-impact employment decisions without appropriate human review, validation, and consideration of applicable law.

6. User Content

You retain ownership of job descriptions and other content you submit to the Services, subject to the rights necessary for JobSelect Labs to process that content to provide the requested Service.

You represent that you have the rights and permissions necessary to submit the content you provide.

You should not submit confidential, sensitive, or personal information unless you have a lawful basis and it is reasonably necessary for the Service. See the Privacy Policy for information about how submitted data is handled.

7. API Keys and API Usage

API keys are credentials that authorize access to applicable hosted Services. You are responsible for keeping your keys confidential and for activity performed using them.

We may impose or change rate limits, quotas, request limits, or other safeguards to protect the Services and users. We may suspend or revoke keys that are abused, exposed, used unlawfully, or associated with activity that threatens the Services.

8. CLI, Model, and Open-Source Components

The JobSelect CLI, JobAnalyze 6k model, datasets, SDKs, and other components may be distributed under separate open-source or package-specific licenses. Where a separate license applies, that license governs the applicable component to the extent of any conflict with these Terms.

Public model weights, datasets, and package releases may be subject to their own repository, model-card, dataset, or package documentation and licenses.

9. Intellectual Property

Except for content and third-party materials that you own or are licensed to use, JobSelect Labs and its licensors retain rights in the Services, branding, website design, documentation, software, and other proprietary materials.

These Terms do not transfer ownership of JobSelect Labs intellectual property to you.

10. Third-Party Services

The Services may rely on or link to third-party providers such as Supabase, Vercel, Render, Hugging Face, and PyPI. Third-party services are subject to their own terms and policies. JobSelect Labs is not responsible for third-party services outside its control.

11. Availability and Changes

We may modify, suspend, discontinue, or restrict any part of the Services at any time. We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at any particular time.

We may update these Terms when the Services or applicable requirements change. The "Last updated" date will identify the latest version. Continued use after an update constitutes acceptance of the revised Terms to the extent permitted by law.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Services or their outputs will be accurate, complete, reliable, current, fit for a particular purpose, uninterrupted, or free from errors or harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, JobSelect Labs and its contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, business opportunities, or goodwill arising from or related to use of the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

14. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless JobSelect Labs and its contributors, officers, and service providers from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

15. Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary to protect the Services, users, or third parties, to address abuse or security concerns, or where you materially violate these Terms.

You may stop using the Services at any time. Account deletion and personal-data deletion are handled as described in the Privacy Policy.

16. Governing Law

These Terms are intended to be governed by the laws applicable to JobSelect Labs and its operator, subject to any mandatory consumer-protection or other laws that apply to you.

Any dispute should first be raised with JobSelect Labs so the parties have an opportunity to resolve it informally. Nothing in this section removes rights that cannot legally be waived.
